Terms of Service

1. Acceptance of Terms

By creating an account or using the Listenscene platform ("Service"), you agree to these Terms on behalf of your organization. If you do not agree, do not use the Service.

2. Description of Service

Listenscene provides an AI-powered voice call center platform that enables organizations to deploy customizable voice assistants on their websites. The Service includes real-time speech transcription, AI-generated call summaries, analytics dashboards, and security controls.

3. Who Can Create an Account

Accounts may only be created by individuals acting on behalf of a business, nonprofit, or other legal entity with the authority to bind that organization. You must be at least 18 years old. Consumer or personal-use accounts are not permitted unless explicitly approved in writing by Hevichay.

4. Account Registration

You agree to provide accurate and complete information and to keep your account credentials confidential. You are responsible for all activity under your organization account and for ensuring that authorized members comply with these Terms. Notify us immediately of any unauthorized use.

5. Acceptable Use

You agree not to use the Service to:

• Harass, abuse, defraud, or harm others
• Collect or process personal data without a lawful basis and appropriate notices or consents
• Transmit malware, viruses, or harmful code
• Circumvent access controls, rate limits, or security features
• Generate or distribute illegal, deceptive, or harmful AI content
• Attempt to reverse engineer, scrape, or overload the Service
• Violate applicable laws, regulations, or third-party rights

7. Account Suspension

We may suspend or restrict access immediately if we reasonably believe your account poses a security, legal, or abuse risk, if you breach these Terms, or if required by law. Where appropriate, we will notify the account owner and provide an opportunity to remedy the issue before permanent termination.

8. Intellectual Property

The Service, including its software, design, and documentation, is owned by Hevichay and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service during your subscription term. You retain ownership of content and data you submit, subject to the license needed for us to operate the Service.

9. Termination

Either party may terminate these Terms at any time. You may cancel from your organization settings. Upon termination, your right to use the Service ends immediately. We may delete organization data after a reasonable grace period, subject to legal retention requirements and our Privacy Policy.

10. Disclaimer of Warranties

The Service is provided "AS IS" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Hevichay is not infallible. We maintain ongoing internal reviews to identify bugs, inconsistencies, and operational risks, and we incorporate feedback from organizations and the public to improve Listenscene. We aim to minimize service interruptions and to resolve issues with professional diligence. However, we cannot guarantee 100% uptime, zero defects, or perfect AI responses at all times. No system of this complexity can.

11. Limitation of Liability

To the maximum extent permitted by law, Hevichay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or data, arising from your use of the Service, even if advised of the possibility of such damages.

12. Changes to the Service and Terms

We may update the Service or these Terms from time to time. Material changes will be communicated by email or in-product notice. Continued use after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Madagascar. Any dispute shall be submitted to the competent courts of Madagascar, subject to mandatory provisions of applicable law.
